GENERAL CONDITIONS OF SALE
1. Object
The purpose of these general conditions of sale is, on the one hand, to inform any potential consumer of the terms and conditions under which the seller proceeds with the sale and delivery of the products ordered, and on the other hand, to define the rights and obligations of the parties in connection with the sale of products by the seller to the consumer. They apply, without restriction or reservation, to all sales by the company EXTEMPOREL of the products offered on its website www.lookcare.fr.
Consequently, the fact for any person to order a product offered for sale on the website of www.lookcare.fr implies full acceptance of these general conditions of sale, of which the Buyer acknowledges having read prior to his order.
All other conditions than those stated herein are binding on the seller only after written confirmation from him. The general terms and conditions of sale are subject to change at any time without notice, provided that they appear on our sales site and take immediate effect on that date.

Automatic recording systems are considered as proof of the nature, content and date of the order. EXTEMPOREL confirms acceptance of its order to the customer at the e-mail address provided by the latter. The sale will only be concluded once the order has been confirmed. EXTEMPOREL reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order. The information given by the buyer, when taking the order, commits him: in the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility in which it could be to deliver the product.

4.Price
The price is expressed in euros.
The price indicated on the product sheets does not include transport.
The price indicated in the order confirmation is the final price, this price includes the price of the products, the costs of handling, packaging and storage of the products, the costs of transport and commissioning.
In the event of an order to a country other than metropolitan France, you are considered to be the importer of the product(s) concerned. Customs duties or other local taxes or import duties or purchase taxes may be required. These rights and sums are not the responsibility of EXTEMPOREL but are the responsibility of the buyer. All orders, whatever their origin, are payable in Euros. EXTEMPOREL reserves the right to modify its prices at any time. The products will be invoiced on the basis of the prices in force at the time of the registration of the orders. The products remain the property of EXTEMPOREL until full payment of the price.

5.Payments
Payment must be made when ordering online by the Buyer. At no time can the sums paid be considered as a deposit or down payment.

To pay for his order, the Buyer has the PayPal payment method.
The Buyer guarantees to EXTEMPOREL that he has the necessary authorizations to use the method of payment he has chosen, when registering his order form.
EXTEMPOREL reserves the right to suspend or cancel any order and/or delivery, regardless of its nature and level of execution, in the event of non-payment of any sum due by the Buyer, in the event of payment incident, or in the event of fraud or attempted fraud relating to the use of the website www.lookcare.fr.
Penalties of an amount equal to the legal interest rate plus five points are automatically applicable to amounts unpaid at the end of a period of ten days following the invoice date or upon notification of the rejection of bank payment for any other means of payment. The delivery of any new order may be suspended in the event of late payment of a previous order, notwithstanding the provisions hereof.

6.Delivery
EXTEMPOREL will make its best efforts to ensure that the order is dispatched within an average of ten (10) working days from the day following that of the Buyer's validation of his order. The items ordered are shipped to the delivery address you provided during the ordering process. The method of delivery for Metropolitan France is the Colissimo, for the DOM TOM the Colissimo Outre-Mer and for the international the Colissimo international. It takes 4 to 5 days for delivery in Metropolitan France and between 7 and 15 days for the DOM TOM and international depending on the destination. If you are not at home or if your mailbox is not appropriate, you will receive a transit advice note and your package will be waiting for you at your post office. In the event of an unusual delay, due to a stock shortage for example, an email will be sent to you.
In any case, the Products will be sent by the usual postal services.
EXTEMPOREL therefore declines all responsibility in the event of excessive delivery times due to postal services or means of transport, as well as in the event of loss of the Products ordered or of a strike. The risks of transport are borne by the Buyer, who must make a reasoned protest to the postal services or to the carrier, within three working days of delivery. Furthermore, it is specified that ownership of the Products ordered will only be transferred to the Buyer upon full payment of the invoice price, including delivery costs.
Delivery problems due to the carrier.
Any anomaly concerning the delivery (damage, missing product compared to the delivery note, damaged package, broken products, etc.) must be indicated on the delivery note in the form of "handwritten reservations", accompanied by the customer's signature. At the same time, the customer must confirm this anomaly by sending the carrier within two (2) working days following the delivery date a registered letter with acknowledgment of receipt setting out the said complaints. The customer must send a copy of this letter by simple mail to:

EXTEMPOREL does not receive customers at the address indicated above.
7. Right of withdrawal
The products must imperatively be returned to EXTEMPOREL in perfect condition for resale, in their original condition (packaging, accessories, instructions, etc.), duly sealed, and accompanied by the return form signed according to the procedure described in article 7.5 above.
If the terms set out above are respected, the refund will be made within 15 days of receipt of the package.

8.Return and refund of products
The products can be returned by the Buyer under the conditions and according to the instructions below:
The products must imperatively be returned to EXTEMPOREL in perfect condition for resale, in their original condition (packaging, accessories, instructions, etc.), duly sealed, and accompanied by the signed return form.
EXTEMPOREL accepts the return of any item purchased on the site if it is returned within 14 days from the date of receipt of its order by the Buyer.
In principle, the shipping costs of the return package remain the responsibility of the Buyer. In the event of a technical anomaly or an error in the references delivered, the return costs will be reimbursed by EXTEMPOREL.
To return an item, the Buyer must follow the following instructions:
1- Use the original packaging to return the product.
2- Complete and attach the Return Slip to be detached from the Delivery Slip. Returns without a return slip are not accepted.

Any risk related to the return of the product is the responsibility of the Buyer.
Failure to comply with the procedure set out above and the deadlines indicated, the Buyer may not make any claim for non-compliance or apparent defect of the products delivered, the products then being deemed to be compliant and free from any apparent defect.

9. Retention of title
EXTEMPOREL retains full ownership of the products sold until full payment of the price, in principal, costs and taxes included.

10. Liability
EXTEMPOREL cannot be held responsible for non-performance of the contract in the event of out of stock or unavailability of the product due to a case of force majeure, disruption or total or partial strike, in particular of the postal services and means of transport and/ or communications.
EXTEMPOREL cannot be held liable for any consequential damages that may arise from the purchase of the products.
EXTEMPOREL cannot be held responsible for any loss of data or files. It is the Buyer's responsibility to make all the necessary backups.
EXTEMPOREL declines all responsibility:
for any interruption of the site;
for any occurrence of bugs;
for any inaccuracies or omissions relating to information available on this site;
for any damage resulting from fraudulent intrusion by a third party leading to a modification of the information made available on the site;
and more generally for any direct or indirect damage, whatever the cause, origin, nature or consequence, including in particular the costs that may arise from the acquisition of goods offered on the site, loss of profits, loss of customers, of data or any other loss of intangible property that may arise from anyone's access to the site or the impossibility of accessing it or from the credit given to any information coming directly or indirectly from the latter.

11. Intellectual Property
In accordance with the laws governing the ownership of literary and artistic rights or other similar rights, this Site and all the elements, brands, designs, models, logos, graphics, etc. found in this Site as well as their compilation are the exclusive property of EXTEMPOREL, the latter granting no licence, nor any right other than that of consulting the Site.
The reproduction or use of all or part of these elements is only authorized for the exclusive purposes of information for personal and private use, any reproduction and any use of copies made for other purposes being expressly prohibited. Any other use constitutes counterfeiting and is sanctioned under Intellectual Property, except with the prior written authorization of EXTEMPOREL.

12.Export
Subject to the rules applicable within the EEC and except with the agreement of our company for the resale of LOOK CARE products and the acceptance of the general conditions of sale implies the commitment by the buyer to sell the products only in the country where they were shipped to him by our company.

13. Applicable law and competent jurisdiction
Sales of EXTEMPOREL products are subject to French law. Any dispute relating to the interpretation, execution or termination of the contract entered into between EXTEMPOREL and the Buyer, even in the event of multiple defendants, shall, in the absence of an amicable agreement, fall under the exclusive jurisdiction of the courts of Paris.

14. Computers and Freedom
The information collected by EXTEMPOREL during any order from the Buyer is necessary for the management of his order by EXTEMPOREL and its commercial partners.
In accordance with the law "Informatique et Libertés" n ° 78-17 of January 6, 1978, the Buyer has a right of access, rectification, opposition and deletion of data concerning him from EXTEMPOREL by contacting customer service:
